NOICC
Notice of Intention to Consider Cancellation (NOICC) of visa can be issued by the department.
The response to the NOICC is crucial as to the department’s decision as to whether to cancel the visa or not, so please consider it carefully. We care and take the matter seriously.
This notice is send as required by law under the cancellation powers the department has based on primarily on section 116 power to cancel or section 109 cancellation for incorrect information.

Genuine Temporary Entrant (GTE) Requirement
This is based on the Ministerial Direction at the time which will assess students based on their circumstances in home country or at the time of visa application, their immigration history among others.
Genuine Temporary Entrant (GTE) Requirement is one of the measures which the government uses to determine and manage student’s stay and the reasons and determine student’s intention to stay in Australia. Genuine Temporary Entrant (GTE) Requirement does not however prevents one from developing and planning for permanent residency
Genuine Temporary Entrant (GTE) is a crucial subjective measure in student visa with substantial ability to influence the visa decision
DIBP considers following factors for Genuine Temporary Entrant (GTE) Requirement in determining the intention of student to stay and study in Australia temporarily:
- Student’s circumstances in home country including academic, work or professional career and determine whether the past study qualification and work experience are in closely related field
- Intention of studying and commitment reasons to return after completion of studies
- Immigration history of applicants already in Australia and their compliance with the Australia laws and visa condition after arriving in Australia
- Relevancy and consistency of studies between student’s past and intended course of study
- Potential circumstances in Australia and connection to Australia
- Value of the course to student’s future, employment and income and their career

Administrative Appeals Tribunal (AAT)/ Migration Review Tribunal (MRT)
Migration and Refugee Division (MRD or MR Division) under Administrative Appeals Tribunal (AAT)/ (formerly known as Migration Review Tribunal (MRT) can be requested to reviews decisions (if the decision is reviewable) to refuse or cancel visas made by a case officer of the Department of Immigration and Border Protection. Further, AAT/MRT can review the decision regarding approval or cancellation of sponsorship and nomination, bond or security amount and much more.
AAT as an independent tribunal has a power under the act to conduct a merits review a decision whereby the tribunal makes an administrative reconsideration of the application. The tribunal makes the decision within the same law or legislative framework as the case officer who is regarded as a primary decision maker and as such cannot make an exception. The tribunal may exercise all the powers and discretions conferred upon the decision maker or case officer. However, the tribunal may not need to consider the departmental policy as the case officer for the department may need to consider in making a decision as such there may be a different consideration in any matter with the different tribunal member.
Under the Migration Act 1958, the tribunal (AAT) has the power to affirm (not change) the primary decision, vary the primary decision, set aside the primary decision and substitute a new decision and remit (return) a matter to Department of Immigration and Border Protection for reconsideration with specific directions. Based on the type of decision and whether the person is in immigration detention, there are specifications as to the reviewable decisions, the applicant for review, how to apply for review, the time limits for application and the application fee.

Under 18 needs welfare arrangements
Enrolled in a Commonwealth Register of Institutions and courses for Overseas for Overseas Students (CRICOS) registered course or have obtained COE from education provider
Will need to meet English Language, Character and Health Requirement, and must hold health insurance as required
Meet Biometric requirement for Nepalese passport holders,
If onshore must have a pre-qualifying visa and hold a current temporary substantive visa

Assessment Level of Provider and Country
DIBP has a right to request any documents and information deemed relevant however documents requirement is based on assessment level of the education provider and the country of applicant. Each education provider and the country of applicant/student’s passport have been given an assessment level which determines the risk factor for the application and the documents requirements therein. Each of the country and provider are given assessment level between 1 to 3; 3 being the riskier of them all and 1 being for university/college with good history and low risk countries. Documents checklist for Nepal along with the education providing college being in assessment level 2 will vary from documents requirements for different assessment level country or if the provider has different assessment level. Assessment level between the two determines the documents requirement matrix. This risk factor determines the English, financial and other requirements.
Student Guardian Visa Subclass 590
For parent or guardian of student under 18 or who needs care

Temporary Graduate – Subclass 485 Visa
Based on completion of 2 years studies by international student
Must have overall 6 equivalent score in IELTS with no less than 5 in each in all four components
Graduate Work Stream
18 months visa for Graduates with qualification in occupations on Medium and Long-term Strategic Skills List (MLTSSL)
Must have skill assessment for Subclass 485 from relevant skill assessing authority
Must meet other criteria and have applied for AFP, Insurance among others.
Post-Study Work Stream
For international student who has applied and were granted their first student visa for Australia on or after 5 November 2011
Must have completed Bachelor, Master and PHD and can be granted visa from 2 to 4 years based on studies
Does not need skill assessment
Must meet other criteria and have applied for AFP, Insurance among others

Professional Year Program
10 months or 44 weeks program approved by the department to get student an industry exposure and get them ready for the job market in addition to 5 extra points to the point score for GSM point test for migrating to Australia
Must have completed Bachelor degree or above, with skill assessment for Subclass 485 and have IELTS 6 especially for accounting graduates and applied Subclass 485
Professional Year along with IELTS 6 will help assess skills for graduates and make them eligible for full skill assessment
Accounting
Developed and approved by CPA Australia, ICAA and IPA, SIMPA is the professional year program for accounting graduates
IT
PYP or Professional Year Program in IT is for accounting graduate monitored by ACS
Engineering
Engineering Australia monitored programs are for engineers to land in the career and get an exposure to the industry as well obtain 5 extra points

Temporary Work (Skilled) Subclass 457 Visa
The visa being abolished and replaced by a new visa system called Temporary Skill Shortage (TSS) Visa which will be coming into effect in March 2018.
Up to 4 years Employer Sponsored Visa with a possibility of applying for permanent residency through Employer Nomination Scheme Subclass 186 Visa
3 stages for visa –
Standard Business Sponsorship – Employer becoming an approved sponsor
Nomination – Employer nominating the visa applicant for visa
Visa Application – Visa applicant applies for 457 visa after being nominated

Regional Sponsored Migration Scheme visa (subclass 187)
Permanent resident visa sponsored by employer in a regional or low population area for skilled overseas worker based on a position offered from the skill list

Prospective Marriage visa (subclass 300)
For people intending to marry your prospective spouse if you have met and know the spouse and be opposite sex to your prospective spouse
9 months visa to enter Australia and get married if sponsored by your fiancé and can apply Partner visa (subclasses 820 and 801) in Australia

Bridging Visas
Bridging visas as its name suggests bridging the gap between one substantive visa and the decision of another application for substantive visa. They come into affect only when there is no substantive visa one holds.

Bridging Visa E (BVE) Subclass 050
Of these Bridging Visas only Bridging Visa B allows travel right and only Bridging Visa A and Bridging Visa B can be inter-changeable and as we go down it is worse. Bridging visa works as a ladder such that one cannot move up from the lower one and higher giving more advantages over the lower ones.
